TERMS AND CONDITIONS OF USE

1. DEFINITIONS
   • “Site” means https://www.muvamo.com and all associated sub-pages.
   • “Operator” / “we” / “us” means Muvamo (represented via Michael Föls).
   • “User” / “you” means any natural or legal person who accesses the Site.
   • “Content” means any text, photo, video, data, link or other material published on the Site, including but not limited to digital PDF guides.
   • “Services” means (i) editorial travel information, destination guides and recommendations, (ii) private on-location photo-shootings booked through the Site, (iii) self-guided tours delivered via online navigation or mobile web-app, and (iv) downloadable or streamed PDF travel guides and other digital products.
2. ACCEPTANCE OF TERMS
   By accessing or using the Site or purchasing any Services you agree to be bound by these Terms, our Privacy Policy and Cookie Policy. If you do not agree, please refrain from using the Site.
3. SCOPE OF SERVICES
   3.1 Travel Information & Blogging – We provide free editorial content designed to inspire and inform travellers; we are not a package tour operator (§ 2 PKG) and do not arrange transportation or accommodation.
   3.2 Recommendations & Affiliate Links – Where we recommend third-party products or services, we do so based on personal opinion and without warranty; affiliate relationships are disclosed.
   3.3 Private Photo-Shootings – We offer paid on-location photography sessions (“Photo-Shootings”). A separate service confirmation e-mail sets out date, time, location, scope, price and deliverables (digital files).
   3.4 Self-Guided Tours – After purchase you receive a link to an online map or progressive web app that provides route guidance, points of interest, text, audio or images (“SGT”).
   3.5 PDF Guides & Digital Products – Paid PDF guides are delivered by instant download or e-mail link immediately after payment (“Digital Products”).
4. USER OBLIGATIONS
   a) You may use the Site only for lawful purposes.
   b) You must not:
   • upload or transmit illegal, defamatory, discriminatory, hateful, pornographic or otherwise objectionable content;
   • violate privacy or intellectual-property rights of third parties;
   • use bots or scraping software without prior written consent;
   • interfere with the Site’s security or integrity;
   • disregard local laws, traffic regulations or safety notices when following SGT routes.
5. USER-GENERATED CONTENT (“UGC”)
   a) Licence grant: By posting UGC you grant us a non-exclusive, royalty-free, worldwide licence to host, store, reproduce, publish, translate and display that content in connection with the Site.
   b) Moderation: We may pre-screen, remove or block UGC at our sole discretion.
   c) Notice & action (DSA, Art. 16–17): If you believe content on the Site is illegal or violates these Terms, please notify us via office@muvamo.com. We will review the notice, act without undue delay and provide a statement of reasons in accordance with the DSA.
6. INTELLECTUAL-PROPERTY RIGHTS
   a) All proprietary Content and Services are protected by copyright and trade-mark law.
   b) Photo-Shootings: We grant you a non-exclusive, perpetual licence for personal use of delivered images; commercial use requires separate written agreement.
   c) SGT and PDF Guides: Licence is single-user, non-transferable. You may store one copy on your personal devices but may not redistribute, resell or publicly share the files or access links.
7. EXTERNAL LINKS
   The Site contains links to third-party websites. We have no influence on their current or future content and accept no liability for them; only the respective provider is responsible.
8. DISCLAIMER OF WARRANTIES
   8.1 Travel information, SGT routes and PDF content are provided “as is” and “as available”. We do not warrant fitness for a particular purpose, e.g. that a hiking trail is open or safe on the day of your visit.
   8.2 Navigation accuracy depends on third-party map data and your device; we cannot guarantee uninterrupted GPS or mobile service.
   8.3 Weather, political conditions and local regulations can change rapidly; you remain responsible for verifying official information (e.g. border rules, trail closures, visa requirements).
9. LIMITATION OF LIABILITY
   9.1 We are liable only for damage caused intentionally or by gross negligence.
   9.2 In the context of SGT and on-location Photo-Shootings we have no duty to supervise your conduct. You participate at your own risk and must comply with all safety warnings, road rules and property access rights.
   9.3 To the extent permitted by law, liability for slight negligence, indirect and consequential damages, loss of data, lost profit or personal injury arising from following SGT routes, using recommendations, or performing poses during photo-shootings is excluded.
10. BOOKING, PAYMENT & CANCELLATION
    10.1 Payment – Prices are shown in euro incl. VAT. We accept [list of payment methods]. Payment for Digital Products and SGT is due in advance; for Photo-Shootings, a 30 % non-refundable deposit is payable upon booking, balance at the shoot.
    10.2 Rescheduling Photo-Shootings – You may request a new date once, subject to availability, if you notify us at least 72 h before the original appointment.
    10.3 Cancellation by You
    • Photo-Shootings: 0–72 h before appointment → 100 % fee; 3–7 days → 30 % fee (deposit forfeited); >7 days → free cancellation.
    • SGT & PDF Guides: Due to instant digital delivery, no cancellation once download or streaming has commenced (see 11.2).
    10.4 Cancellation by Us – If we must cancel (e.g. illness, force majeure) we offer either a new date or full refund at your choice.
11. CONSUMER RIGHT OF WITHDRAWAL (DIGITAL & SERVICE CONTRACTS)
    11.1 For Photo-Shootings booked online, EU consumers may withdraw from the contract within 14 days unless the service has been fully performed within that period (§ 18 (1) Z 3 FAGG).
    11.2 For Digital Products (PDF Guides, SGT), you expressly consent to immediate download/streaming and acknowledge that you thereby lose your 14-day withdrawal right once delivery begins (§ 18 (1) Z 11 FAGG).
    11.3 To exercise your right, send an unambiguous statement to office@muvamo.com; model withdrawal form available in Annex I B FAGG.
12. AFFILIATE & ADVERTISING DISCLOSURE
    Some articles contain affiliate links or paid sponsorships. If you purchase through those links we may receive a commission at no extra cost to you. Such relationships do not influence our editorial independence.
13. ONLINE DISPUTE RESOLUTION
    EU ODR platform: https://ec.europa.eu/consumers/odr. We are neither willing nor obliged to participate in out-of-court dispute settlement before a consumer arbitration board.
14. GOVERNING LAW AND JURISDICTION
    Austrian substantive law applies; venue is Vienna, unless a mandatory consumer forum prevails.
15. CHANGES TO THESE TERMS
    Significant changes will be announced on the Site at least 14 days before they take effect. Continued use constitutes acceptance.
16. SEVERABILITY
    If any provision is or becomes invalid, the remaining provisions stay in full force.
